Daniel Fischer (Rechtsanwalt)

Daniel Fischer (* 22 May 1953 in Bern; † 20 June 2015 in Zurich) was a Swiss lawyer and professor[1][2] of international business law at the SRH University of Applied Sciences in Berlin.

He became known throughout Switzerland as the representative of so-called Lehman victims who had invested in Lehman Brothers securities on the advice of Swiss banks. Among others, he represented the approximately 350[3] to 500[4] Members of the Investor Self-Help Group and 50[5][6] other Lehman victims of the approximately 7,000 so-called Lehman victims in Switzerland.[7] In earlier years, he acted in the interests of investors against hidden retrocessions[8][9][10][11][12][13] appeared.[14] Since 2012, he has taken action against Swiss banks that do not refund the retrocessions owed.[15][16]

In addition, he represented a large number of aggrieved investors in, inter alia[17] in the Madoff case[18][19][20] as a member of an international alliance of lawyers,[21] UBS Wealth Management Global Property Funds,[22][23][24] K1,[25][26][27][28] Auriga Ltd.[29] etc. Most recently, he represented the Swatch Group against UBS AG[30][31] and the INFINA claimants against St. Galler Kantonalbank.[32][33][34]

In the field of white-collar crime, he was primarily concerned with crime due diligence in addition to corporate governance. He investigated numerous white-collar frauds and suggested that in all white-collar crimes, certain patterns of behavior (modules) always occur, making criminality easier to detect.[35] In the context of a suspicion-creation strategy for white-collar crime, he introduced the term “Econ Crime”[36] which, in addition to white collar crime, describes know-how crime.

In the context of the financial crisis, he developed a form of dispute resolution called the “Swiss Banking Medarp” system, a combination of mediation and arbitration. This was intended to help Swiss banks regain trust.[37] In addition, he frequently spoke out publicly in favour of investment protection; in particular, he advocated the introduction of class action lawsuits and the criminalisation of certain forms of investment advice given by banks.[38][39][40][41][42] This development, too, should ultimately serve the investor.

He was an expert of the United Nations Commission on International Trade Law UNCITRAL. He also held the title of Certified Fraud Examiner (CFE) and was a member of the board of directors and training director[43] of the Association of Certified Fraud Examiners of the Central & Northern European Chapter and Switzerland.

In addition to his legal activities, he was co-editor of the online musical magazine “imScheinwerfer” and hosts features on musicals on Radio Top.[44][45][46] Most recently, he wrote a series on the history of the Swiss musical.[47][48]
